Terms and Conditions PRIVILEGIUM Loyalty Reward Program

The PRIVILEGIUM Program (“Program”) is a rewards program offered by participating Corpus Studios (“Corpus”) to its customers residing in Quebec. Membership in the Program (the “Membership”) is limited to individuals only and limited to one account per person. You must be 16 years of age or older and a legal resident of Canada to be eligible for membership in the program. Eligible minors must obtain permission from a parent or guardian before joining.

 

The program consists of two membership statuses: Privilegium, Privilegium Plus. Obtaining Privilegium Plus status requires a minimum spend per year, as we explain below. All Membership levels enjoy numerous benefits offered by Corpus in its sole discretion from time to time (“Employee Benefits”). Benefits may vary by level and some levels may have more benefits than others. The type, timing and availability of any Benefits (including Rewards (as defined below), special offers, contests, unique experiences, exclusive events and early access to Products) will be determined by Corpus, at its sole discretion.

Corpus may, in its sole discretion, modify, limit or change the rules of the statutes, regulations, benefits, eligibility for membership or any other feature of a particular status, or may terminate a particular status at any time and in its sole discretion, without notice, except to the extent expressly provided in these Terms or required by applicable law.

All members automatically acquire Privilegium status upon registration. Subject to withdrawal from the Program, a member remains an Insider member indefinitely, unless the minimum annual spend required to achieve Privilegium Plus status is met.

All rewards are non-transferable, have no cash value (unless required by law) and cannot be sold, returned or exchanged for Privilegium points, cash, another product, card -gift or an electronic gift certificate, unless the Corpus offer is special. Corpus is not responsible for lost, stolen or damaged rewards. You remain solely responsible for any taxes you must pay in connection with your receipt of rewards. Rewards can only be shipped to Canada. Some rewards may only be available to residents of Quebec. Corpus employees and service providers are not eligible for the program.

Corpus places great importance on your privacy. BY SUBMITTING AN APPLICATION TO MEMBER THE PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN AGREES) TO BE BOUND BY THE APPLICABLE CORPUS PRIVACY POLICY. We use and retain the information we collect to, among other things, detect security incidents and protect against malicious, deceptive, fraudulent or illegal activities, including attempts to manipulate accumulated Privilegium points and benefits or violate These conditions.

Corpus may, in its sole discretion, alter, limit or modify any Program rules, regulations, benefits, Membership eligibility requirements or any other features of the Program (including the assignment of any of its obligations to customers under the Program, at any time to another person or entity, without recourse) or may terminate the Program at any time in its sole discretion, by posting such changes on the Corpus website. For users in Quebec: Where required by law, Corpus will send you an email notice of these changes, within 90 to 60 days before the effective date of the change, indicating the modified terms and the date of the modification takes effect.

YOUR UNINTERRUPTED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES TO THE TERMS MEANS THAT YOU ACCEPT THESE CHANGES.

Corpus reserves the right to exclude individuals from the program or remove Privilegium points from a member or to cancel orders that do not comply with Corpus policy in its sole discretion, to a reasonable extent. In particular, any abuse, manipulation or "gaming" of the program or its rules (determined by Corpus), non-compliance with any terms of the program, inactivity as a member for more than 24 months, any misrepresentation or any conduct harm to the interests of Corpus may subject its members to revocation of their membership or deduction of its points obtained through such abusive or manipulative activities, cancellation of orders and will affect their eligibility for future participation in the program. Corpus uses a third-party vendor to monitor purchases and identify activities that violate program terms or Corpus policy. Corpus uses this data to help make decisions about participating in the program, awarding Privilegium points and fulfilling orders. Membership is non-transferable and purchases under Membership must be made by the member. If your Membership is terminated or otherwise canceled, all points in your account automatically expire. Corpus reserves the right to make changes to its website and these Terms at any time. It is your responsibility to check or review these Terms from time to time so that you are informed of any changes. By enrolling in the Program, you agree to be bound by any such changes to these Terms.

 

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CORPUS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING FROM CHANGES TO THE PROGRAM OR CANCELLATION OF THE PROGRAM. THIS IS AN EXHAUSTIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA , REVENUE OR PROFITS, PROPERTY LOSS OR DAMAGE AND THIRD-PARTY CLAIMS. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON CORPUS'S LIABILITY DESCRIBED HEREIN APPLY IN THE EVENT OF BREACH OR TERMINATION OF THE CONTRACT OR WHETHER THERE IS A CIVIL TORT, CIVIL LIABILITY BY NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BY AGREEING TO THESE TERMS, YOU VOLUNTEER AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN VOLUNTEERLY AGREES) THAT YOU HAVE GIVE UP YOUR RIGHT TO SEEK THESE DAMAGES FROM CORPUS AND THAT THIS CONSTITUTES APPROPRIATION REASONABLE RISK.

All concepts, texts, graphics, logos, button icons, audio sequences, the selection and organization thereof, in connection with the program and any proprietary software are protected by copyright (c) 2022 The Boutiques Yoga Fitness Corpus Inc, ALL RIGHTS RESERVED. The compilation (meaning the collection, organization and assembly) of all Program Content is the exclusive property of Corpus and is protected by the laws of Canada. Any software used in connection with the Program is the property of Corpus or its software suppliers, and is protected by the laws of Canada. Unless otherwise indicated in a particular portion of the Program Materials, you are permitted to electronically copy and print in hard copy portions of the Program Materials for the sole purpose of accessing the Program and the Services therein for your personal use. Any other use of the Program Materials, including reproduction, modification, distribution, republication, transmission, display or performance, without the prior written permission of Corpus is strictly prohibited.
